Allahabad High Court rules that selection cannot be cancelled or services terminated after allowing a person to work for a long time.
The case involved teachers who were selected for employment at Dr. Shakuntala Mishra National Rehabilitation University.
They had submitted their qualifications, appeared for interviews, and were recommended for appointment.
However, their services were later terminated by the university.
The court found that the cancellation of their selection was conducted in violation of natural justice principles, as the decision was made by the Executive Council without proper hearing.
The university also failed to follow the appropriate procedures outlined in the Uttar Pradesh Government Servants (Discipline and Appeal) Rules.
The court concluded that the termination order was illegal and arbitrary, as the petitioners were qualified for their positions.
Therefore, the court allowed the petition and set aside the impugned order.
