The Supreme Court has made a decision that an accused person cannot get automatic bail just because a chargesheet is filed without permission from a valid authority.
The decision was made by Chief Justice DY Chandrachud and Justice JB Pardiwala.
They looked at Section 167 of CrPC, which allows an accused person to get bail if an investigation is not finished within a set time.
However, the bench did not agree with an argument that said permission from a valid authority was needed for the chargesheet to be valid under Section 167. They decided that this was a matter for the prosecution, not the investigation.
The court looked at four important questions and decided that a chargesheet filed without permission from a valid authority could still be valid if it was filed within a reasonable time frame.
They also said that previous court decisions that allowed incomplete chargesheets could not be used as a defense in this case.
